of the Central Commission of the Republic of Belarus on Elections and Conducting Republican Referenda
On July 5, 2001
On Explanation of Execution of Some Provisions of the Ordinance of the President of the Republic of Belarus of June 26, 2001 N 20 "On Obligatory Declaring of Incomes and Property of a Candidate for the President of the Republic of Belarus, His Close Relatives, Wife (Husband) and Her (His) Parents and Some Other Measures Directed on Conducting of Open, Free and Fair Elections" |
In connection with the appeals coming on the execution of some provisions of the Ordinance of the President of the Republic of Belarus of June 26, 2001 N 20 “On Obligatory Declaring of Incomes and Property of a Candidate for the President of the Republic of Belarus, His Close Relatives, Wife (Husband) and Her (His) Parents and Some Other Measures Directed on Conducting of Open, Free and Fair Elections” the Central Commission of the Republic of Belarus on Elections and Conducting Republican Referenda (further – the Central Commission) on the basis of the clause 1 of the article 33 of the Electoral Code of the Republic of Belarus explains:
1. Declarations on incomes and property of the person nominated for the candidate for the President of the Republic of Belarus, and also declarations on incomes and property of his close relatives (parents, children, adopters, adoptees, native brothers and sisters, grandfather, grandmother, grandchildren), wife (husband) and her (his) parents irrespective of place of living and place of stay of the persons mentioned shall be presented to the Central Commission by the person, nominated for the candidate for the President of the republic of Belarus, or be the head of his initiative group.
2. Declarations on incomes and property, application on consent to ballot for the President of the Republic of Belarus and questionnaire (biographic data) of the person, nominated for the candidate for the President of the Republic of Belarus, shall be presented to the Central Commission since July 21 till August 4, 2001 including.
3. Close relatives of the person nominated for the candidate for the President of the Republic of Belarus, his wife and her relatives may forward declarations on incomes and property in accordance with the form approved by the Council of Ministers of the Republic of Belarus of April 4, 2001 N 457 “On approving the Form of Declaration on Incomes and Property”, via fax for further presentation to the Central Commission.
4. Persons nominated for the candidate for the President of the Republic of Belarus and heads of their initiative groups shall be given in the Central Commission blanks of declarations on incomes and property or shall make its by their own. Declarations on incomes and property may be filled in handwritten or typewritten.
5. In the clause 1 of the declaration on incomes and property the incomes obtained in the calendar year that precedes the year of holding elections, i.e. since the January 1, 2000 till the December 31, 2000, shall be indicated, and in clauses 2-6 – the property that belongs on the right of ownership on the date of presentation of the declaration shall be indicated.
6. Assurance of the declaration on incomes and property by the state tax bodies and also testimony of signature’s authenticity in notarial order are not demanded on declaration.
7. Declaration on incomes and property of minorities, including adopted children, and also minor grandchildren shall be fulfilled and signed by one of the parents (adopters) who indicates his surname near the signature in the declaration.
8. While fulfilling the declaration on incomes and property by close relatives of the person who is proposed as a candidate for the President of the Republic of Belarus his wife and her parents should indicate in column “Surname, Name, Patronymic Name” of the declaration in what family relations they are with the person who is proposed as a candidate for the President of the Republic of Belarus.
9. The Central Commission during ten days since the day of registration of the candidate for the President of the Republic of Belarus passes to mass media for compulsory publication information on general sum of annual income and information on property that are indicated in clauses 2-6 of the declaration with respect to every person who is mentioned in clause 1 of the present Resolution.
